Abstract

The research paper deals with the issue of witness with respect to women. It is a comparative evaluation of the issue under reference in view of the famous collection of Islamic law i.e. Fᾱtᾱwᾱ Ᾱ’lᾱmgeeri and the contemporary (Pakistani) laws. As regards the matter of women’s witness, Islam gives it a due place. As it is evident from the proofs of the Islamic law that a woman can give her evidence in civil matters. Similarly, the two women are considered equal to one man in witness. As far the matter of judicial cases is concerned so actually a women cannot give her evidence. The philosophy behinds this rules is to keep the woman away from the grievances and responsibilities as possible. Because evidence is not a right but is a responsibility in the real sense. The narrative advocating the issue of witness is discrimination towards women is indeed a baseless observation. In this article an attempt has been done to compare both Islamic and contemporary laws, which will benefit the readers.
