Abstract
Judiciary is considered to be the important pillar in the modern democratic system. Judiciary is supposed to eliminate cruelty and injustices from a society. Islam also teaches us to take our cases to court of government and law. Since people take their cases into courts which decide their fates based on proves and evidences available, there are high chances of mistakes in the logical decisions made in the judiciary. Judges, being human, are prone to errors and mistakes despite their best possible efforts and high expertise. In order to safe guard oneself from such mistakes and errors of judgements made by the judges, people have their rights to submit an appeal against decision declared by the judges. This right of appeal is not only a legal one but Islam also renders this right to every person. So, this is a legal as well as religious right. The present articles offers Islamic perspective and teachings about filing an appeal against the decision made in the court of law. The present article will cover many such related perspectives like the meaning of justices, its method and process, type and condition of the decisions, the care involved etc. etc. We will also discuss the rulings in Islam about what kind of decisions can a judge forfeit or cancel and what kind of decisions made by a judge cannot be challenged or altered by certain judges. The present article will discuss all these things in detail and will at the end conclude the results and outcome of all the discussion in a clear way.
